Digital Millennium Copyright Act
We respect the intellectual property rights of others just as we expect others to respect our rights. Pursuant to Digital Millennium Copyright Act, Title Seventeen, United States Code, Section Five Hundred Twelve, a copyright owner or their agent may submit a takedown notice to us via our DMCA Agent. As an internet service provider, we are entitled to claim immunity from said infringement claims pursuant to the safe harbor provisions of the Digital Millennium Copyright Act.
Notice of Infringement Claim
To submit a good faith infringement claim to us, you must submit notice to us that sets forth the following information. You must provide a physical or electronic signature of the copyright owner or a person authorized to act on their behalf. You must identify the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site. We require you to identify the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material. Providing URLs in the body of an email is the best way to help us locate content quickly.
Furthermore, you must provide information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted. You must include a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. Finally, you must include a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Important Warning Regarding False Claims
Please be advised that under applicable federal law, any person who knowingly materially misrepresents that material or activity is infringing may be subject to severe civil penalties. These include monetary damages, court costs, and attorneys fees incurred by us, by any copyright owner, or by any copyright owners licensee that is injured as a result of our relying upon such misrepresentation. You may also be subject to criminal prosecution for perjury. We strongly recommend consulting an attorney before sending a notice if you are unsure whether your material is protected by copyright laws.
Counter Notification Procedures
If you have received a notice of material being takedown because of a copyright infringement claim, you may provide us with a counter notification in an effort to have the material restored to the site. Said notification must be given in writing to our DMCA Agent and must contain substantially the following elements. You must provide your physical or electronic signature. You must identify the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
Additionally, you must provide a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled. You must provide your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.
Repeat Infringer Policy
We take copyright infringement very seriously. Pursuant to the repeat infringer policy requirements of the Digital Millennium Copyright Act, we make a list of DMCA notices from copyright holders and make a good faith effort to identify any repeat infringers. Those who violate our internal repeat infringer policy will have their accounts terminated. We reserve the right to terminate access to the platform for users who are found to repeatedly upload copyrighted material without authorization. We will terminate user accounts in appropriate circumstances when users are deemed to be repeat copyright infringers.
Modifications to Policies
We reserve the right to modify the contents of this page and its policy for handling DMCA claims at any time for any reason. You are encouraged to check back to review this policy frequently for any changes. Any modifications to this policy will be effective immediately upon posting on this website. Continued use of the platform after any such modifications constitutes your acceptance of the revised policy and your agreement to be bound by its terms.
